1. Who we are
flyxart.com is operated by FLYXART LTD ("we", "us"), a company registered in England and Wales under company number 17482055, with its registered office at 128 City Road, London EC1V 2NX, United Kingdom. Contact: contact@flyxart.com.
2. These terms
These terms apply to every order placed on flyxart.com. Please read them, together with our Refund policy, Shipping policy and Privacy policy, before you order.
3. Our artworks
Our artworks are original FLYXART designs, offered as canvas prints or as hand-painted canvases made to order by our studio artists. Colours on screen can differ slightly from the finished artwork. Hand-painted pieces are individually painted, so small variations are part of their character.
4. Orders and contract
When you place an order, you'll receive an email confirming we have received it. The contract between us is formed when we confirm your order is accepted, which happens when we start production. We may refuse an order, for example if an item is unavailable or a price error has occurred; if so, we'll tell you and refund any payment in full.
5. Prices and payment
Prices are in pounds sterling (GBP) and include VAT where applicable. Delivery costs are shown at checkout. Payment is taken when you place your order, through our secure payment providers.
6. Custom artworks
If you send us your own image, you confirm that you own it or have permission to use it, and that it doesn't infringe anyone else's rights. We may refuse images that are unsuitable or infringe third-party rights. Before painting starts we may share a proof or preview for your approval.
7. Delivery
Production and delivery times are explained in our Shipping policy. The artwork becomes your responsibility once it has been delivered to the address you gave us.
8. Cancellations, returns and faulty items
Your right to cancel and our returns process are explained in our Refund policy. Nothing in these terms affects your statutory rights as a consumer.
9. Intellectual property
All FLYXART designs, images and texts on this website remain our property, or that of the artists we work with. Buying an artwork gives you ownership of the physical piece, not the right to reproduce the design.
10. Our responsibility to you
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable. We do not exclude or limit our liability where it would be unlawful to do so.
11. Changes to these terms
We may update these terms from time to time. The version on the website when you order is the one that applies to your order.
12. Law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
